Question by Eric S: You have legal same-sex marriage in South Africa but Life in jail in Lesotho?

How did South Africa go all the way to legalizing same-sex marriage, which I think is awesome and great!? But why is the rest of Africa so extreme in their dealing with the same issue?

Some countries in Africa have Death Penalties (life imprison) for same-sex marriage?

Does the South Africa government warn their travelers to be careful about these drastic customs differences?

I think it is horrible if 2 pretty girls are kissing, they would execute them...it sounds so unjust

There are run of the mill travel advisories. But no, South Africa does not warn it's travellers to (for instance to Lesotho) on this particular issue.

Border crossings in this part of the world are time consuming and often frustrating, and therefore usually done for a specific purpose (business, tourism). For this reason people are usually quite aware that they are in a very different country!

There are a few points worth noting.

The countries that excercise these extreme penalties (e.g Sudan) are not neighbouring countries of ours. In practice, countries like Lesotho seldom if ever excercise harsh penalties. Law enforcement in most African countries are at best very restricted. So what is on the back and what happens on the ground is very different. Murder, smuggling, robbery, assault are all illegal in all Southern African countries. For the most the countries cannot enforce these laws, so laws on petty issues are just ignored, unless it relates to a big cultural taboo.

In South Africa, where it is legal, it is still in practice a big cultural taboo among black African societies. The South African government typically plays lip service to what is seen as progressive and trendy (e.g. gender equality, freedom of sexual orientation, freedom of expression, general human rights) but in practice promote neither these issues (which don't have very enthusiastic support from the mass electorate anyway), nor the real burning issues like violent crime.
